Since 1957, moral rights have been clearly identified as part of the author's property. In the first part, we return to the opposition in the nature of the two properties, moral and patrimonial, and give a detailed explanation. The second part focuses on the functional inseparability of these two properties. Unfortunately, the European Commission, with its neoliberal choices, is threatening this balanced property and wants to replace it with a private legal monopoly; but the Court of Justice, on the basis of often dysfunctional texts, maintains a compatible interpretation......
