Résumé :

In the mind of a contemporary jurist, the notion of author is indissolubly linked to the figure of the creator who is its starting point. However, in the period from 1880 to 1920 this was not the case. Because of the issues at stake at that time, the creator in practice was often deprived not only of the rights to the work, but also of his or her authorship. Paradoxically, however, this was not to the detriment of his interests...
At the end of the analysis made in this article, one can see many parallels between the notion of author as it was at the turn of the 20th century and as it is constructed today. May this retrospective contribute to a better understanding of what the notion of author is and should be in the near future.
